Stichting Haarlem Marketing ("Haarlem Marketing") is a foundation under Dutch law, established in Haarlem and registered with the Chamber of Commerce under number 41224725.

Introduction
Haarlem Marketing collects data about you through its services and websites haarlemmarketing.nl visithaarlem.com and haarlemconventionbureau.nl ("Websites"). We think it is important to inform you what data we collect about you and why, what we do with the data and how you keep control over your data. We describe this in this privacy statement in a clear manner.

1. Definitions

Processor Responsible Party the party that determines the purpose and means for Processing Personal Data. Haarlem Marketing is Processor Responsible for the Personal Data.

Processor the party processing Personal Data on behalf of and for Haarlem Marketing.

Data Subjects the individuals from whom Personal Data is Processed.

Personal Data all data that (in)directly lead or can lead to the identification of a person (a Data Subject).

Processing/Processing any operation involving Personal Data. Examples include: storing, copying, consulting, sharing, or recording Personal Data.

2. Categories of Personal Data
Haarlem Marketing Processes the following Personal Data about you:

  • Contact information, such as: (last) name, (business) address, (business) phone number, (business) email address;
  • Identity information, such as: gender, date and place of birth;
  • Financial and administrative data, such as: bank account number, VAT number and Chamber of Commerce number;

  • Other data, such as: data from curriculum vitae and other data from personnel files.

3. How Haarlem Marketing Obtained Personal Data
Haarlem Marketing obtained your Personal Data in one or more of the following ways:

  • You have provided your Personal Data to us yourself, for example, when you have contacted us, visited our Website, interacted with us, when we are executing an (employment) contract with you, or subscribed to our newsletter;
  • The Personal Data is derived from public (business) social media platforms, public (business) websites or public records;
  • The Personal Data is derived from the analysis of the Website.

4. Purposes of Processing
Haarlem Marketing Processes Personal Data only for the following purposes:

  • To carry out the (statutory) objectives of Haarlem Marketing;
  • To carry out the campaigns of Haarlem Marketing;
  • To carry out the marketing activities of Haarlem Marketing;
  • To keep in touch;
  • To comply with legal obligations;

5. Principles Processing
Haarlem Marketing Processes Personal Data only when permitted under one of the following bases in the AVG:

  • Consent; Haarlem Marketing requests consent from you for the Processing of Personal Data in cases where it is necessary. You can withdraw the consent you have given at any time.
  • Agreement; Haarlem Marketing may Process Personal Data necessary for the performance of an (employment) agreement.
  • Legal Obligations; Haarlem Marketing has legal obligations to Process Personal Data, for example for tax legislation.
  • Justified Interest; Haarlem Marketing Processes Personal Data insofar as it has a legitimate interest to do so and such Processing does not disproportionately infringe on the protection of the privacy of Data Subjects.

6. Retention Periods Personal Data.

Haarlem Marketing retains Personal Data for as long as it is necessary for the purpose for which it was originally collected or as long as necessary to comply with legal obligations. After this period, Personal Data will be destroyed unless there is a compelling reason not to do so. Documents stored digitally will be permanently deleted. Paper documents are physically destroyed.
The following specific retention periods are used for the following categories of Personal Data:

  • Personal data required under tax laws: 7 years.

7. Security of Personal Data
Haarlem Marketing is committed to the proper security of your Personal Data and takes all technical and organizational measures necessary to secure your Personal Data. For example, Haarlem Marketing has taken the following security measures, among others:

  • Personal data is exchanged securely; employees of Haarlem Marketing do not use private email addresses for business purposes.
  • Only authorized employees of Haarlem Marketing have access to Personal Data stored in a secure CRM system.
  • All devices used are secured by passwords and/or two factor authentication.
  • The digital systems of Haarlem Marketing are secured with technical measures and are monitored.

  • Only authorized employees of Haarlem Marketing have access to the premises;
  • In principle, no Personal Data will be transferred to third parties that are not Processors without your consent. Personal Data will never be sold to third parties.
  • Haarlem Marketing has entered into Processor Agreements with each Processor.
  • In principle, Haarlem Marketing only processes Personal Data within the European Economic Area (EEA).

The Website contains links to third-party websites. Haarlem Marketing is not responsible for the content of third-party websites or how they handle your Personal Data.

8. Data breach
A data breach is any breach of the security of Personal Data leading to any unauthorized Processing thereof. Haarlem Marketing has an internal policy on how to deal with (possible) data breaches. In the event of a (possible) data breach, Haarlem Marketing will make every effort to limit and/or prevent any adverse consequences for you. Furthermore, Haarlem Marketing will report the data breach to the competent authorities if it is obliged to do so.

9. Rights of Data Subjects
If Haarlem Marketing Processes Personal Data about you, you have the following privacy rights:

  • The right to access Personal Data; You have the right to know what Personal Data we Process about you.
  • The right to have Personal Data amended or corrected; You have the right to have inaccurate and/or complete Personal Data corrected and/or completed by us.
  • The right to object to the Processing of Personal Data and the right to restrict the Processing of Personal Data;

Our contact information allows you to contact us if you wish to exercise your rights. You can only make a request with respect to your own Personal Data. In order to establish your identity, we ask you to attach a copy of your identity document to your request where you may black out the photograph and the Citizen Service Number.

You will receive a response to your request within four (4) weeks. We cannot fully comply with your request in all cases, for example when your request conflicts with a legal obligation. You will always receive an explanation of why we cannot (fully) fulfill your request in a specific case.

10. Cookies
Haarlem Marketing makes use of cookies. A cookie is a small text file containing information. That information is about the behavior of the person visiting the Website. There are different types of cookies. On the Website under the heading "Cookie preferences" in the footer explains what cookies are used and for what purpose.
